Information on this site, including vehicle listings, descriptions, photographs, pricing, valuations, and BidBetter content, is provided for informational purposes only and does not constitute an offer to sell or a binding contract. All sales are subject to a written purchase agreement executed by Peak Motor Cars, LLC and the buyer, and are subject to vehicle availability.

Intellectual Property

All content on this site — including the Peak Motor Cars name, marks, logo, photographs, video, copy, and design — is owned by or licensed to Peak Motor Cars, LLC and is protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Third-party marks (Porsche, Lamborghini, Ferrari, Mercedes-Benz, McLaren, Bentley, Rolls-Royce, etc.) are the property of their respective owners and are used solely for descriptive purposes. No affiliation or endorsement is implied.

Acceptable Use

• Do not use the site for any unlawful purpose, to harass any person, or to interfere with site operation.
• Do not attempt to access non-public areas, scrape inventory data programmatically, or reverse-engineer the site or its underlying systems.
• Do not submit false, misleading, or fraudulent information through any contact, acquisition, or financing form.

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

All vehicle-related warranty disclosures are governed by the written purchase agreement and the FTC Buyer's Guide accompanying the vehicle.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PEAK MOTOR CARS, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limitations; in such jurisdictions our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Peak Motor Cars, LLC and its affiliates from and against any claim, liability, loss, damage, or expense (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the site.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of these Terms or your use of the site shall be the state or federal courts located in Ventura County, California, and you consent to personal jurisdiction in those courts.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual-property rights.
